TERMS AND CONDITIONS
Effective 1 January, 2023; the following policies shall apply:
Dealer Fee/ Appointment Fee:
Baker Firearms operates by appointment only. Appointments to transfer a firearm are $85 and last exactly as long as it takes to transfer a firearm. Appointments to transfer ammunition are $20 or 20% of the online retailers invoice total, whichever is greater, appointments to transfer ammunition last exactly as long as it takes to transfer a shipment of ammunition. Multiple firearms will require multiple appointments which swill be consecutive time slots. Transactions will be done back to back for the sake of efficiency and to save the prospective purchaser from being subjected to multiple state imposed Dealer Record Of Sale (D.R.O.S.) fees. Should a prospective firearm(s) purchaser buy firearm(s) or ammunition online and have them shipped to Baker Firearms the prospective purchaser will be notified upon their order's arrival and an appointment will be made so that the prospective purchaser can come in and fill out paperwork and or start the 10 day waiting period. In the event that the prospective purchaser misses three appointments, their firearm(s) and or ammunition will be shipped back to the online retailer (COD) from which the firearm(s) and or ammunition were purchased. Shipping will take place only after any applicable dealer fees/ storage fees have been paid. All dealer fees apply for missed appointments. If you need to re schedule or cancel your appointment you must contact Baker Firearms no later than 24 hours prior to your scheduled appointment.
Online Purchases that AREN'T California Compliant
Should a prospective purchaser purchase an unsafe handgun (off roster) or other firearm that isn't approved for sale in California from an online retailer and the prospective purchaser does not have a valid exemption, the firearm will need to be returned to the online retailer as it is not lawful for Baker Firearms to transfer the firearm to the prospective purchaser. Baker Firearms will only ship the firearm back to the retailer after a $85 fee is paid to Baker Firearms. Storage fees will apply (See above storage fee policy). Baker Firearms will not be held responsible for return shipping fees or liability for the item(s) during transit. It is the purchasers responsibility to know what is legal to purchase before the purchase has been made. Please contact us if you are unsure. PC 27535 (a) prohibits a person from purchasing more than one handgun or semiautomatic centerfire rifle within any 30-day period. This subdivision does not authorize a person to make an application to purchase both a handgun and semiautomatic centerfire rifle within the same 30-day period. Should a prospective purchaser have a handgun AND a semiautomatic centerfire rifle shipped in to Baker Firearms within a 30 day period a storage fee will apply. Please read the Storage section below.
Payment
Payment in full is due prior to starting D.R.O.S. Unpaid accounts are subject to late charges of 3% per month. ALL SALES ARE FINAL. Refunds will not be issued for special order firearms or for failure to pass an eligibility check. If you have any questions please contact Baker Firearms BEFORE you have items shipped in or BEFORE you start the eligibility check process, whichever applies to your situation. Baker Firearms accepts payment in the form of cash, check or credit card. There is a loss of cash discount when paying with credit or debit card.
Storage
The first 30 days of storage are free. The free 30 day storage period begins when Baker Firearms notifies the purchaser that their order has arrived. A storage fee of $100 per item, per 30 days (or any portion of a 30 day period) will be charged beginning on the 31st day and ending when the purchaser takes possession of their property. Storage Fees must be paid in full before the purchaser may take possession of their property. Eligibility (background) checks and consequent state imposed fees may apply. Should unpaid storage fees and interest surpass the monetary value of the item(s) being stored or if the item(s) are deemed to be unclaimed or abandoned, the item(s) will become property of Baker Firearms and will be disposed of as Baker Firearms sees fit. This policy applies to all items shipped to Baker Firearms. Please don't abandon property at Baker Firearms. Please don't plan to store things at Baker Firearms long term, storage fees adds up quickly.
Background Check
California firearms dealers are instructed not to use the federal NICS check. Firearms dealers operating in California are required by law to use California's proprietary Dealer Record Of Sale or D.R.O.S. system.
D.R.O.S is $37.19 and the fee schedule can be broken down as follows; Dealer Record of Sale $31.19, Safety and Enforcement $5, Safety Training $1. The state imposed D.R.O.S fee is non refundable under any circumstances or for any reason(s).
Ammunition eligibility checks are broken down into two categories. Standard and Basic. The Standard eligibility check is $1 and is for persons who have purchased a firearm in California since 2014. The basic ammunition eligibility check is $19 and is for people who have not purchased a firearm in California since 2014. Ammunition Eligibility checks fees are non refundable under any circumstance or for any reason(s).
Warranties
All merchandise sold is "as is" and the prospective purchaser has the opportunity to inspect item(s) before purchase. Issues should be directed to the products respective manufacturer. Baker Firearms expressly disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, except as required by law.
Returns and Refunds
All sales are final. Refunds will not be issued for any reason. If you have issues or concerns with your item(s) please direct your questions to that items respective manufacturer. If you can not find the contact information for the item's manufacturer please let us know so that we can help put you in touch with them.
Background Check results returned as "undetermined"
The California Department of Justice is authorized by Penal Code section 28220 to temporarily delay a firearm transaction for up to 30 days from the date of transaction if the Department is unable to immediately determine the purchaser's eligibility to own/possess firearms. If 30 days has passed since the transaction date and the Department is still unable to determine the purchaser’s eligibility to own/possess firearms, or whether the firearm involved in the sale/transfer is stolen, the Department will notify the dealer. It will then be at the dealer’s sole discretion whether or not to release the firearm to the prospective firearms purchaser. Baker Firearms is committed to firearms safety and community safety and has a "do not deliver" policy in place that it will adhere to should the CA DOJ return an "undetermined" result on an eligibility check.
If you believe there is a discrepancy in your eligibility to own/possess firearms, you can obtain a copy of your California record by completing the Request for Live Scan (BOF 8016RR) form located on the Department’s website: http://oag.ca.gov/firearms/forms. You should review the record, identify any incomplete or missing court information, and then follow up with the court where your case was held and request the court submit corrected information to the DOJ's Bureau of Criminal Information and Analysis (BCIA). If you disagree with any information in your record, you should follow the instructions in the letter for disputing inaccuracies. You may wish to obtain an attorney for legal advice and who can best represent your interests on how to restore your rights to buy firearms.
Safety
Baker Firearms would like to make the to the DOJ publication "California Firearms Laws Summary" available to all of its customers and prospective customers. Should any customers need a copy of the DOJ pamphlet which summarizes California firearms laws printed, please make this request before you come to fill out paperwork to start the 10 day wait and background check process so that we have an opportunity to print it off for you.
WARNING
Firearms must be handled responsibly and securely stored to prevent access by children and other unauthorized users. California has strict laws pertaining to firearms, and you may be fined or imprisoned if you fail to comply with them. Visit the website of the California Attorney General at https://oag.ca.gov/firearms for information on firearm laws applicable to you and how you can comply.
Prevent child access by always keeping guns locked away and unloaded when not in use. If you keep a loaded firearm where a child obtains and improperly uses it, you may be fined or sent to prison.

All firearms and ammunition purchasers and users should receive proper instruction and training in the safe and proper use of firearms and ammunition products prior to purchasing and using these products.

Handling firearms or firearms parts can expose you to lead and other petroleum products known to the State of California to cause cancer, birth defects, or other reproductive harm. Be Aware of Scams
Baker Firearms is aware of scammers attempting to use our warehouse address to validate their claims of legitimacy. Baker Firearms is working with the FTC to have this website removed. As with anything online, if there is no contact phone number listed, and the "seller" demands payment via Bitcoin, Gift Cards, or Pay Pal friends and family, it's highly likely a scam. Remember, if it sounds too good to be true, it likely is.
